Special Report: “Supreme Court to Rule on Constitutionality of SOX’s Public Company Accounting Oversight Board"
A new Special Report is now posted for subscribers: “Supreme Court to Rule on Constitutionality of SOX’s Public Company Accounting Oversight Board: Free Enterprise Fund, et al. v. PCAOB, et al.” Here, Peter M. Stone, Edward Han and Stacy E. Wiesbrock, litigation attorneys and members of the Securities Litigation and Enforcement practice at Paul, Hastings, Janofsky & Walker LLP, explain that the U.S. Supreme Court has agreed to decide whether provisions of the Sarbanes-Oxley Act that created the Public Company Accounting Oversight Board are constitutional. If the Supreme Court rules in favor of the petitioners in finding that PCAOB is unconstitutional, this could mean the end of PCAOB (and possibly SOX since there is no severability provision in SOX). Argument is scheduled for the fall term.
